1. Overview

Flytographer Enterprises Ltd. (“Flytographer”) offers an internet-based service through its website, www.flytographer.com (the “Site”), that allows travellers to book a photo shoot in over 190 cities worldwide by selecting a photographer from Flytographer’s global roster of over 400 professional photographers (the “Service”).

Protecting our customers’ private information is our highest priority.

This Privacy Policy governs all data collection and usage by Flytographer, including through the Site.  By using the Site, you consent to the data collection and usage practices described in this Policy.

2. Collection of Your Personal Information

In providing the Service, Flytographer may collect personally identifiable information, such as your name and email. If you purchase Flytographer’s products and services, we collect billing and credit card information and store photographic images. This information is used to complete the purchase transaction and render the Service. Flytographer may also collect anonymous demographic information, which is not unique to you, such as your age and gender.  We may gather additional personal or non-personal information in the future.

We will not publish or sub-license your photographic images without your prior consent. Information about your computer hardware and software may be automatically collected by Flytographer. This information can include: your IP address; browser type; domain names; access times; and referring website addresses. This information is used for the operation of the Service, to maintain quality of the Service, and to provide general statistics regarding use of the Site.

Flytographer encourages you to review the privacy statements of websites you choose to link to from the Flytographer website so that you can understand how those websites collect, use and share your information.  Flytographer is not responsible for the privacy statements or other content on websites outside of the Site.

3. Use of Your Personal Information

Flytographer collects and uses your personal information to operate the Site and deliver the services you have requested. Flytographer may also use your personally identifiable information to inform you of other products or services available from Flytographer and its affiliates.  Flytographer does not sell, rent or lease its customer lists to third parties.  Flytographer may keep track of the websites and pages our users visit within Flytographer in order to determine what Flytographer services are the most popular. This data is used to deliver customized content and advertising within Flytographer to customers whose behaviour indicates that they are interested in a particular subject area.

Flytographer will disclose your personal information, without notice, only if required to do so by law or in the good faith belief that such action is necessary to: (a) conform to the edicts of the law or comply with legal process served on Flytographer or the site; (b) protect and defend the rights or property of Flytographer; and, (c) act under exigent circumstances to protect the personal safety of users of Flytographer, or the public.

You acknowledge that the Site, the content and photographic images displayed on the Site and any underlying technology or software used in connection with the Site contain Flytographer’s proprietary information.  Flytographer shall have the right to monitor the content that you provide to the Site, but shall not be obligated to do so. The contents of the Site are protected by copyright as individual works, collective work and/or compilations, pursuant to Canadian and foreign copyright laws.  You agree to abide by all copyright notices and other restrictions contained in the Site.  Access to, and use of, the Site is solely for your personal, non-commercial use. Accessing, using, displaying, performing, distributing, copying or downloading content from the Site for other than personal and non-commercial use is expressly prohibited without prior written consent of Flytographer. By downloading or reproducing any information from this Site, you accept and agree to the conditions described in this Statement in their entirety without modification unless otherwise agreed to in writing by Flytographer and you.
